Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Order Culture platform and websites operated by Order Culture LLC ("Order Culture," "we," "us"). By using our services, you agree to these Terms.
The service
Order Culture provides restaurants with online ordering websites, kitchen order management, loyalty and gift-card programs, customer relationship tools, and email and SMS marketing. We also facilitate on-demand delivery through third-party providers such as DoorDash.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.
Orders, payments & fees
Payments are processed by Stripe. Applicable platform subscription fees, transaction tech fees, and any delivery fees are disclosed at signup and at checkout. Restaurants are the merchants of record for food orders placed through their sites. Taxes are the responsibility of the applicable restaurant.
Delivery
Where delivery is offered, it may be fulfilled by third-party providers. Delivery availability, timing, and fees are subject to those providers' terms and local conditions.
Acceptable use
You agree not to misuse the service, including by attempting to disrupt it, access it without authorization, or use it to send unlawful, deceptive, or unsolicited messages. Marketing messages sent through the platform must comply with applicable laws, including the TCPA and CAN-SPAM Act.
Intellectual property
Order Culture and its licensors retain all rights in the platform and its software. Restaurants retain rights to their own brand, menu, and customer data.
Disclaimers & limitation of liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Order Culture is not liable for indirect, incidental, or consequential damages arising from your use of the service.
Changes
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
